ഉത്തർ പ്രദേശിലെ ഹത്രാസിൽ ദളിത് പെൺകുട്ടി കൂട്ട ബലാത്സംഗത്തിന്നിരയായി കൊല്ലപ്പെട്ട സംഭവത്തിൽ രാജ്യമാസകാലം പ്രതിഷേധം അലയടിക്കുകയാണ്. പത്തൊൻപതുകാരി പെൺകുട്ടിയെ കഴിഞ്ഞ സെപ്റ്റംബർ 14 നാണ് നാലുപേർ ചേർന്ന് ക്രൂരമായി പീഡിപ്പിക്കുകയും കൂട്ട ബലാത്സംഗം ചെയ്യുകയും ചെയ്തത്. പോലീസിനെ അറിയിക്കാതിരിക്കാൻ പെൺകുട്ടിയുടെ നാവ് മുറിച്ചു മാറ്റുകയും കുടുംബത്തെ നിരന്തരമായി ഭീഷണിപ്പെടുത്തുകയും ചെയ്യുകയുണ്ടായി. കൃഷി സ്ഥലത്ത് ഗുരുതരാവസ്ഥയിൽ കണ്ടെത്തിയ പെൺകുട്ടിയെ ആദ്യം അലിഗഢിലെ ആശുപത്രിയിൽ പ്രവേശിപ്പിക്കുകയും പിന്നീട് സെപ്റ്റംബർ 28 ന് ഡൽഹി എയ്‌മ്സിലേക്ക് മാറ്റുകയും ചെയ്തു. തൊട്ടടുത്ത ദിവസമാണ് മരണമടഞ്ഞത്.
പോസ്കോ ഉൾപ്പെടെയുള്ള ശക്തമായ നിയമങ്ങളും നിർഭയ തുടങ്ങി സ്ത്രീകൾക്ക് സുരക്ഷയും നീതിയും ഉറപ്പാക്കുന്നതിനാവശ്യമായ നിരവധി സംവിധാനങ്ങളും നിലനിൽക്കുമ്പോഴും ഇരകളുടെ എണ്ണം ക്രമാതീതമായി വർദ്ധിക്കുന്നുവെന്നത് ആശങ്ക സൃഷ്ടിക്കുന്നു .
കത്വ കേസിന്റെ പശ്ചാത്തലത്തിൽ പന്ത്രണ്ട് വയസ്സിൽ താഴെ പ്രായമുള്ള കുട്ടികളെ ബലാത്സംഗം ചെയ്യുന്നവർക്ക് വധ ശിക്ഷ ലഭ്യമാക്കുന്ന പുതിയ നിയമ നിർമാണം നടത്തുകയുണ്ടായി. പതിനാറു വയസ്സിൽ താഴെയുള്ളവരെ ബലാത്സംഘം ചെയ്താൽ ലഭിക്കുന്ന കുറഞ്ഞ ശിക്ഷ നിലവിൽ പത്തു വർഷമായിരുന്നുവെങ്കിൽ ഇരുപത് വർഷമാക്കി വർധിപ്പിച്ചും നിയമം പാസ്സാക്കി. നിയമങ്ങൾ ഒരു ഭാഗത്ത് കർശനമാക്കുമ്പോൾ തന്നെ തെളിവുകളുടെ അഭാവവും അന്വേഷണത്തിലെ കാല താമസവും മറ്റു ബാഹ്യ ഇടപെടലുകളും നിമിത്തമായി യഥാർത്ഥ പ്രതികൾ പലരും ശിക്ഷിക്കപ്പെടാതെ പോവുന്നു. ഭരണകൂടം നിതാന്ത ജാഗ്രത പാലിക്കുന്നുവെന്നും അടിയന്തിര നടപടികൾ സ്വീകരിക്കുന്നുവെന്നുമുള്ള അവകാശ വാദങ്ങൾ ഉന്നയിക്കുമ്പോൾ തന്നെ നിയമ സംവിധാനത്തിലെ നൂലാമാലകൾ പ്രതികൾക്ക് സമൂഹത്തിൽ സ്വൈര്യ വിഹാരത്തിന് അവസരം ഒരുക്കുന്നു.
ശരിയായ രീതിയിലുള്ള നിയമ പ്രക്രിയ നിലനിന്നാൽ മാത്രമേ നിയമ വാഴ്ചയും അത് വഴി ജനാധിപത്യവും യാഥാർഥ്യമാവുകയുള്ളൂ. സ്ത്രീ സുരക്ഷ നിയമങ്ങളുടെ അപര്യാപ്തതയല്ല മറിച്ച് അവ നടപ്പാക്കുന്നതിലെ ജാഗ്രതക്കുറവ് തന്നെയാണ് ഇത്തരം പൈശാചികതകൾ അവർത്തിക്കപ്പെടുവാൻ ഇടയാക്കുന്നത് എന്നത് കൊണ്ട് തന്നെ ഭരണ കൂടം ജാഗ്രത കാട്ടേണ്ടതുണ്ട്, നീതി പരിപാലന സംവിധാനം കാര്യക്ഷമമാകണം.
