ബാലനീതി ( ശ്രദ്ധയും സംരക്ഷണവും) നിയമം 2015 എന്ന നിയമമാണ്.
കുട്ടികളുടെ അവകാശലംഘനം സംബന്ധിച്ച പരാതി പരിഹരിക്കുന്നത് എല്ലാ ജില്ലയിലും രൂപീകരിക്കപ്പെട്ടിട്ടുള്ള CWC അഥവാ ചൈൽഡ് വെൽഫെയർ കമ്മിറ്റികളാണ്.ഒരു ചെയർമാനും ഇതര നാലംഗങ്ങളുമുള്ള ഈ കമ്മിറ്റിയിൽ അധ്യാപകർ, അഭിഭാഷകർ,മന: ശാസ്ത്ര വിദഗ്ദ്ധർ കുട്ടികളുടെ വിഷയത്തിൽ ഇടപെടലുകൾ നടത്താറുള്ള പൊതുപ്രവർത്തകർ എന്നിവരാണുള്ളത്.
കുട്ടികൾ നേരിട്ടോ കുട്ടികൾക്ക് വേണ്ടി മാതാപിതാക്കൾ, രക്ഷിതാക്കൾ, ചൈൽഡ് ലൈൻ പ്രവർത്തകർ എന്നിവരെല്ലാം നൽകുന്ന പരാതിയിന്മേലോ CWC നിയമനടപടികൾ ആരംഭിക്കുകയും നിയമലംഘനം ബോധ്യപ്പെട്ടാൽ ക്രിമിനൽ നിയമനടപടികൾ സ്വീകരിക്കുന്നതിന് പോലീസ് ഉദ്യോഗസ്ഥരോട് നിർദ്ദേശിക്കുന്നതുമാണ്

കേരള സർക്കാരിന്റെ തണൽ പ്രോജക്ട് ടോൾ ഫ്രീ നമ്പർ 1517 എന്നിവയിൽ വിളിച്ച് ഏതൊരു വ്യക്തിക്കും കുട്ടികളുടെ അവകാശലംഘനം സംബന്ധിച്ച് പരാതി നൽകാവുന്നതാണ്.24×7 പ്രവർത്തിക്കുന്ന ഈ നമ്പരുകളിൽ രജിസ്റ്റർ ചെയ്യുന്ന പരാതികൾ ചൈൽഡ് ലൈൻ പ്രവർത്തകർ മുഖേനയും ജില്ലാ ശിശുസംരക്ഷണ യൂണിറ്റ് വഴിയും ചൈൽഡ് വെൽഫെയർ കമ്മിറ്റി മുമ്പാകെ എത്തുന്നതാണ്.

കുറ്റകൃത്യങ്ങളിൽ ഏർപ്പെടുന്ന കുട്ടികളുടെ കാര്യത്തിൽ തീരുമാനങ്ങൾ ഏറ്റെടുക്കുന്നത് മൂന്നംഗ JJB അഥവാ ജുവനൈൽ ജസ്റ്റിസ് ബോർഡാണ്.ഫസ്സ്ക്ലാസ്സ് ജുഡീഷ്യൽ മജിസ്ട്രേറ്റ്, സാമൂഹ്യ പ്രവർത്തകർ ,അഭിഭാഷകർ എന്നിവർ ഉൾപ്പെടുന്നതാണ് ഓരോ ജില്ലയിലേയും ജുവനൈൽ ജസ്റ്റിസ് ബോർഡ്.പ്രായപൂർത്തിയാകാത്ത കുട്ടികളെ മുതിർന്ന കുറ്റവാളികളോടൊപ്പം വിചാരണ ചെയ്യരുതെന്ന് ബാലനീതി ( ശ്രദ്ധയും സംരക്ഷണവും) നിയമം 2015 അനുശാസിക്കുന്നു.
മാത്രമല്ല, ഇത്തരം കുട്ടികളെ കുറ്റവാളികൾ/പ്രതികൾ എന്നീ പേരുകളിൽ വിവരിക്കരുതെന്നും നിയമവുമായി സംഘർഷത്തിൽ ഏർപ്പെട്ടിരിക്കുന്ന കുട്ടികൾ അഥവാ Child in Conflict with Law /CCL എന്ന് മാത്രമാണ് സൂചിപ്പിക്കേണ്ടതെന്നും
നിയമം വ്യക്തമാക്കുന്നു.CCL നോട് കാര്യങ്ങൽ ചോദിച്ച് മനസ്സിലാക്കേണ്ടത് കുട്ടികളുടെ മന: ശാസ്ത്ര പരിജ്ഞാനമുള്ള പോലീസ് ഉദ്യോഗസ്ഥരാണെന്ന വിചിന്തനത്തിൽ എല്ലാ ജില്ലകളിലും സ്പെഷ്യൽ ജുവനൈൽ പോലീസ് യൂണിറ്റ് അഥവാ SJPU പ്രവർത്തന സജ്ജമാണ്.ഇന്ത്യൻ ശിക്ഷാ നിയമം ഏഴ് വർഷത്തിന് മേൽ ശിക്ഷ നിഷ്കർഷിക്കുന്ന കുറ്റകൃത്യങ്ങളിൽ 16 വയസ്സിന് മുകളിൽ പ്രായമുള്ള CCL ന് കുറ്റകൃത്യസമയത്ത് മുതിർന്നവരുടെ മാനസികാവസ്ഥയുണ്ടോ എന്ന് മന: ശാസ്ത്ര വിദഗ്ദ്ധർ അടങ്ങുന്ന നിർദ്ദിഷ്ട കമ്മിറ്റി പരിശോധിക്കുന്നതും പ്രാഥമിക വിലയിരുത്തൽ റിപ്പോർട്ട് കുട്ടികളുടെ കോടതിയിലേക്ക് സമർപ്പിക്കുകയും തുടർന്ന് കോടതി ഉചിതമായ നടപടികൾ സ്വീകരിക്കുന്നതുമാണ്.

2005 ൽ നിലവിൽ വന്ന The Commissions for the protection of childrughts act എന്ന നിയമപ്രകാരം രൂപവത്കരിക്കപ്പെട്ടിരിക്കുന്ന കുട്ടികളുടെ കോടതികൾ കുട്ടികൾക്കെതിരെയുള്ള ചുഷണങ്ങളിൽ വിചാരണ നടത്തി ശിക്ഷ വിധിക്കുന്നു.

ബാലാവകാശ സംരക്ഷണത്തിനുള്ള കമ്മീഷനുകൾ നിയമം 2005 പ്രകാരം കേന്ദ്രത്തിലും എല്ലാ സംസ്ഥാനങ്ങളിലും ബാലാവകാശങ്ങളുടെ കാവലാളായി ബാലാവകാശ കമ്മീഷനുകൾ നിലവിലുണ്ട്.കുട്ടികളുടെ അവകാശങ്ങൾ സംബന്ധിച്ച് സർക്കാർ നയങ്ങളിൽ ഇടപെടലുകൾ നടത്തുന്നതിനും കുട്ടികളുടെ വിദ്യാഭ്യാസ അവകാശലംഘനം , ലൈംഗിക അതിക്രമങ്ങൾ ഇവ സംബന്ധിച്ച് കൃത്യമായ നീതി നിർവ്വഹണം ഉറപ്പാക്കുന്നതിനും ബാലാവകാശ സംരക്ഷണത്തിനുള്ള സംവിധാനങ്ങൾ കാര്യക്ഷമമായി പ്രവർത്തിക്കുന്നുവെന്ന് വിലയിരുത്തുന്നതിനും കമ്മീഷനുകൾ സജീവമായി ഇടപെടുന്നു.
