ഒറ്റയ്ക്കോ കൂട്ടായോ അവകാശമോ അധികാരമോ താത്പര്യമോ ഉള്ള വീടാകാം.ഈ നിയമത്തിന്റെ വകുപ്പ് 17 പ്രകാരം ഗാർഹിക അതിക്രമത്തിന് ഇരയായ വ്യക്തിക്ക് യാതൊരു വിധ രേഖാമൂലമുള്ള അവകാശങ്ങളും ഇല്ലെങ്കിലും പങ്കിട്ടു പാർത്ത ഗൃഹത്തിൽ താമസിക്കുന്നതിനുള്ള അവകാശമുണ്ട്.
ഗാർഹിക അതിക്രമത്തിന് ഇരയായ വ്യക്തി തുടർന്നും താമസിക്കുന്നതിനും ഉപദ്രവിക്കുന്ന ആൾ മാറിത്താമസിക്കുന്നതിനും റെസിഡന്റ്സ് ഉത്തരവ് നൽകുന്നതിന്
19 -ാം വകുപ്പ് വ്യവസ്ഥ ചെയ്യുന്നു.
എന്നാൽ ജസ്റ്റിസുമാരായ എസ്.ബി.സിൻഹ , മാർക്കണ്ഡേയ കട്ജു എന്നിവരടങ്ങിയ ഡിവിഷൻ ബെഞ്ച് എസ്.ആർ .ബത്ര vs തരുൺ ബത്ര എന്ന കേസ്സിൽ 15/12/2000 -ാം തീയതി നൽകിയ വിധിയിൽ രേഖാമൂലമോ കൂട്ടുകുടുംബം സമ്പ്രദായപ്രകാരമോ ഭർത്താവിന് അവകാശമുള്ള ഗൃഹത്തിൽ മാത്രമേ ഭാര്യയ്ക്ക് പാർപ്പിടാവകാശം ലഭ്യമാകൂ എന്ന് വിധിച്ചു.ഈ വിധി PWDV ആക്ട് 2005 ന്റെ അന്തസ്സത്തയ്ക്ക് എതിരായിരുന്നൂ.ഈ വിധിയെ അസാധുവാക്കിക്കൊണ്ട് 15/10/2020 -ാം തീയതി ജസ്റ്റിസുമാരായ അശോക് ഭൂഷൺ, ആർ.സുഭാഷ് റെഡ്ഢി, എം.ആർ.ഷാ എന്നിവരടങ്ങിയ മൂന്നംഗ ഡിവിഷൻ ബെഞ്ച് ചരിത്രപ്രധാനവും സ്ത്രീ ശാക്തീകരണത്തിന് ശക്തമായ ഐക്യദാർഢ്യം പുലർത്തുന്നതുമായ
വിധി സതീഷ് ചന്ദർ അഹുജ vs സ്നേഹ അഹുജ എന്ന കേസ്സിൽ സ്ത്രീ സമൂഹത്തിന് നൽകി.വിവാഹമോചിതയായാലും ഭർത്താവുമൊത്ത് താമസിച്ചിരുന്ന ഗൃഹത്തിൽ ജീവിതാവസാനം വരെ താമസിക്കുന്നതിന് ഒരു സ്ത്രീയ്ക്ക് അവകാശമുണ്ടെന്നും ഗൃഹം ഭർത്തൃബന്ധുക്കളുടെ പേരിലാണെങ്കിൽ പോലും ഈ അവകാശം നിലനിൽക്കുമെന്നും കോടതി വിധിച്ചു.
സതീഷ് ചന്ദർ അഹുജയുടെ ഉടമസ്ഥതയിലുള്ള ഗൃഹത്തിന്റെ മുകളിലത്തെ നിലയിൽ പുത്രനായ റെവീണും ഭാര്യ സ്നേഹ അഹുജയും താമസിച്ച് വന്നിരുന്നു. അഭിപ്രായഭിന്നതകളെ തുടർന്ന് റെവീൺ മാതാപിതാക്കളുടെ സമീപത്തേയ്ക്ക് താമസം മാറ്റുകയും വിവാഹമോചനക്കേസ്സ് ഫയൽ ചെയ്യുകയും ചെയ്തു.കുടിയിറക്കാതിരിക്കാൻ സ്നേഹ അഹുജ PWDV നിയമപ്രകാരം സംരക്ഷണ ഉത്തരവ് നേടി.തുടർന്ന് സതീഷ് ചന്ദർ അഹുജ വസ്തുവിലുള്ള തന്റെ പരിപൂർണ്ണ അവകാശം ചൂണ്ടിക്കാണിച്ചും ഭർത്താവ് ജീവിച്ചിരിക്കെ ഭാര്യയെ സംരക്ഷിക്കേണ്ട ഉത്തരവാദിത്തം ഭർത്തൃപിതാവിനില്ലെന്നും ചൂണ്ടിക്കാണിച്ച് നൽകിയ സിവിൽ കേസ്സിൽ സ്നേഹ അഹുജയ്ക്കെതിരെ ശാശ്വത നിരോധന ഉത്തരവും ഭർത്തൃപിതാവിന് മാത്രം അവകാശപ്പെട്ടിടത്ത് താമസിച്ചതിനാൽ നഷ്ടപരിഹാരവും വിധിച്ചു.വിചാരണക്കോടതി നടപടികൾ റദ്ദാക്കിയ ഡെൽഹി ഹൈക്കോടതി വിധിയ്ക്കെതിരെയുള്ള അപ്പീലിൽ ഭർത്തൃപിതാവിന്റെ ഗൃഹത്തിൽ താമസിക്കുന്നതിനുള്ള അവകാശം PWDV നിയമം 2005 ഉറപ്പ് നൽകുന്നുവെന്ന് വിധിച്ച് സതീഷ് ചന്ദർ അഹുജ നൽകിയ കേസ്സിൽ സുപ്രീം കോടതി മൂന്നംഗ ബെഞ്ച് പുനർവിചാരണ ഉത്തരവായി.
